When purchasing real property held in Trust, it differs from a Probate purchase. The timing of a Trust sale is not lengthy as a Probate Sale since the court is usually not involved. The details of the sale are in accordance with the terms Trust.
In making an offer, there are required Trust forms necessary, and the offer is presented to the estate representative who will then accept, counter, or reject the offer as with traditional sales. Buyers of a Trust sale must remember seller is deceased. There usually isn’t anyone to disclose much about the property that may negatively affect the property’s value. This is a possible risk. Therefore, it is best to hire an experienced real estate representative who understands the important due diligence process in a Trust sale and what the estate can or cannot disclose.
